Reminders

  • Note: Effective July 1, 2016 excavators and utility owner/operators who fail to abide by the Mississippi Regulation of Excavations may be subject to a penalty and/or fines. To see the recently passed Senate Bill SB 2755 please go to: msdamageprevention.com.
  • Warning: utility & municipal owners please make certain any electrical and/or fiber optic cables feeding traffic lights, street lights and/or traffic cameras are protected. If you are a member of MS811, please check to be sure that we have your database already.   If not a member of MS811 please contact Amy for information on becoming  a member at (601) 368-1150.
  • Locators:  on locate requests tagged as Update, you should verify the marks are still visible.
  • Excavators:  “Emergency excavation” shall mean excavation at times of emergency involving danger to life, health or property or a customer service outage. Every person who shall engage in such emergency excavation shall take all necessary and reasonable precautions to avoid or minimize interference with or damage to existing underground utility lines and underground facilities in and near the excavation area. Please see the law for full details by going to MS811 website @ www.ms811.org.

PHMSA Ruling
The Pipeline and Hazardous Materials Safety Administration (“PHMSA”) may enforce federal pipeline safety law in Mississippi beginning January 1, 2016. 49 C.F.R. § 196. Federal law:
 - Requires all “excavators to call 811 before digging”, and defines “excavation” as “all excavation activity involving both mechanized and non-mechanized equipment, including hand tools.” 49 C.F.R. §§ 196.3 and 196.103.
 - Makes no exemptions of any kind, not even for homeowners, farmers, or routine road and railroad maintenance.  Federal law also does not recognize any tolerance zones or make emergency excavation exceptions. 49 C.F.R. §§ 196 and 198.
 - Fines of up to $200,000 per violation per day, up to $2,000,000 could be levied.

Damage Information Reporting Tool (DIRT)

Attention All Members Submitting DIRT report:
CGA's Damage Information Reporting Tool (DIRT) supports all stakeholders by collecting and analyzing underground damage and near miss events. With your submissions, the DIRT report works to consistently depict as accurate a picture of the status of damage prevention as possible. This helps the industry in directing education, measure and trend efforts, develop best practices, and guide legislation for damage prevention.

Any CGA stakeholder may submit events to DIRT. Methods include a single event field form, automated spreadsheet, database or XML data upload. Please visit www.cga-dirt.com to get started and find information, tutorials and a registration link.
