EDITORIAL
On May 29th 2015, Nigeria ushered in the new Government of President Muhammadu Buhari, GCFR with over 52 heads of governments and foreign dignitaries. The Director General, Prof. Deji Adekunle on behalf of the Management and staff of NIALS, salutes all Nigerians and renew our best wishes and regard for the new administration. Before leaving office the immediate past President, Dr Goodluck Ebele Jonathan GCFR assented to three significant Bills thus bequeathing the Violence Against Persons (Prohibition) Act 2015, Administration of Criminal Justice Act 2015 and the Cyber Crime (Prohibition and Prevention) Act 2015 to the Criminal Justice Sector.
The Administration of Criminal Justice Act, which has been described as “revolutionary” holistically addresses the challenges bedevilling the Criminal justice system in Nigeria especially in the investigation and prosecution of criminal cases, remand of suspects in prison custody without trial, plea bargaining procedure and non-custodial penal orders.
The Violence Against Persons (Prohibition) Act (VAPPA) prohibits female circumcision or genital mutilation, forceful ejection from home and harmful widowhood practices. It also seeks to protect all persons from violence as depicted by the definition of rape, which has been extended to include the rape of men and boys, in line with current international standards.
The Cybercrimes (Prohibition and Prevention) Act 2015 provides legal bases for the investigation and prosecution of cyber crimes. The offences provided in the Act reflect the most current thinking on Cyber offences as illustrated by the Council of Europe’ Cybercrimes Convention 2004 (Budapest Convention) and the Commonwealth Secretariat’s Model law on Cybercrimes.
NIALS of course is an active player in the major initiatives to improve the Criminal Justice system in Nigeria and has taken steps to mainstream these important instruments into some of our courses namely the Courses for Prosecutors and on Seizure of Criminal proceeds. There will naturally be a lot of commentaries to shed more light on these laws and we will do our best to keep you in the loop.
